Privacy Policy of the Czech Battery Cluster

Czech Battery Cluster CIN: 17170877, with registered office at Purkyňova 649/127, Medlánky, 612 00 Brno, registered in the Association Register kept by the Regional Court in Brno, under the file number L 28361, declares that when processing the personal data of subjects, it always proceeds in accordance with the principles set out below under Article 5 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter referred to as the “GDPR Regulation”):

  • Principles of legality, correctness and transparency of processing– personal data of data subjects are always processed by Czech Battery Cluster on the basis of a valid legal title, correctly and transparently;
  • The principle of limitation of data processing– personal data of the data subjects are collected and processed by the Czech Battery Cluster solely for legitimate purposes. Czech Battery Cluster does not process personal data in a manner which is incompatible with those purposes;
  • The principle of minimization of processing of personal data– Czech Battery Cluster processes personal data only in an appropriate, relevant and necessary scope in relation to the purpose for which they are processed;
  • The principle of accuracy of processed personal data– Czech Battery Cluster processes personal data in an accurate and, if necessary, updated form. Czech Battery Cluster takes reasonable steps to ensure that personal data which are inaccurate with regard to the purposes for which they are processed are erased or corrected without delay;
  • The principle of time limitation of data storing and processing– Czech Battery Cluster stores and processes personal data in a form enabling the data subjects to be identified for no longer than it is necessary to achieve the purposes for which they are processed;
  • The integrity and trust principle of the processed personal data– Czech Battery Cluster processes personal data in a manner that ensures adequate security of personal data, including its protection by appropriate technical or organizational measures against unauthorized or unlawful processing and against accidental loss, destruction or damage;
  • Employees, members of corporate bodies and other persons working with Czech Battery Cluster when processing personal data, comply with the rules and procedures set out in the GDPR Regulation and the Internal Directive on Personal Data Protection, including the safeguards introduced to protect personal data.

 

Applying data subjects‘ rights to Czech Battery Cluster

Data subjects at Czech Battery Cluster  may, under the conditions set out in Articles 15 to 22 of the GDPR, apply the following rights to their processed personal data:

  • Right of access to processed personal data

The right of access is the right of the data subject to be provided with the following information from Czech Battery Cluster: (a) whether his or her personal data are being processed, (b) for what purpose, (c) what personal data are processed, (d) whether personal data are transferred to other recipients, (e) for what time his/hes personal data are processed, (f) information about his / her rights in relation to the processed personal data. At the same time, they can obtain a copy of the processed personal data.

  • The right to correct the processed personal data

The right to correct includes the right of the data subject to request Czech Battery Cluster to correct improperly processed personal data or adding to incomplete processed personal data.

  • The right to delete processed personal data

The right of cancellation includes the right of the data subject to request Czech Battery Cluster the deletion of processed personal data in the absence of a valid legal title for their processing. The data subject has no right to request Czech Battery Cluster to erase the processed personal data if Czech Battery Clusterhas a valid legal title for their processing (i.e. especially for the time when Czech Battery Clusteris authorized to process it for performance of the membership or the fulfillment of legal obligations).

  • The right to limit the processing of personal data

The right to limit the processing includes the right of the data subject to request Czech Battery Cluster of the limitation of the scope of processing of personal data in the following cases: (a) the data subject denies the accuracy of the processed personal data; – the processing may be limited to the time of the decision; (b) the processing is unlawful, but the data subject only requests processing restrictions; (c) Czech Battery Clusterpersonal data only needs to identify, exercise or defend legal claims; (d) the data subject has raised an objection to the processing until its settlement.

  • The right to the portability of the processed personal data

The right to portability includes the right of the data subject to request and obtain the processed personal data by the Czech Battery Cluster in a structured, commonly used and machine-readable format for the purpose of handing over to another trustee (the right to request the transfer to another Trustee in technically feasible cases). This right may be exercised only on the condition that the processing is based on the legal title of performance of the membership or the consent of the data subject and is performed by Czech Battery Cluster via inf. system (automated).

  • The right to object to the processing of personal data

The data subject has the right to object in cases where processing of his personal data by Czech Battery Cluster is based on the legal title, the authorized interests of the trustee or for the purpose of direct marketing. After submitting the objections to Czech Battery Cluster it may not further process the personal data of the data subject unless he / she can substantiate the legitimate reasons for their further processing that outweigh the interests or rights and freedoms of the data subject or demonstrate the need for their processing to determine, exercise or defend their claims.

 

The above-mentioned rights must always be exercised together with the personal data manager; it is not possible to apply those rights against Czech Battery Cluster in cases where the processing is only in the position of the processor for the purpose.

The above-mentioned rights can be applied by the data subject to Czech Battery Cluster in written form with an officially certified signature at Purkyňova 649/127, Medlánky, 612 00 Brno; in electronic form via an electronic message with electronic certified signature sent via email to sekretariat@czechbatterycluster.cz or Data Box ID: (to be stated within 1.Q 2023).

 

Czech Battery Cluster hereby informs the data subjects that they have the possibility to file a complaint with the Office for Personal Data Protection under the conditions set out in Article 77 of the GDPR if they believe that the processing of their personal data by Czech Battery Cluster GDPR has been violated.

 

Czech Battery Cluster hereby informs the data subjects that they have the right to effective judicial protection under the conditions set out in Article 79 of the GDPR if they consider that their rights have been violated as a result of the processing of their personal data by Czech Battery Cluster contrary to the GDPR.
